Wisconsin State Supreme Court Strikes Down Mask Mandate

March 31, 2021

The Wisconsin mask mandate was set to expire on April 5th, but today’s ruling by the state Supreme Court cuts that short by a few days. So what does no statewide mandate mean for your business?

First off, you will want to check with your local municipality to see what is in place. For example, the city of Milwaukee still has a mask requirement in place. Just because your city or town doesn’t have anything in place right now does not mean that they will not move to change that, so please keep an eye out for that.

Second, you as a business can still require your patrons to wear masks. Best practice is to have clear signage placed at your entrance letting customers know your policy. Be sure your staff knows what is expected as well.  If your business makes appointments or takes reservations, you may want to inform customers at the time that you confirm their slot so they are aware before they arrive.

While you are making the decision that is best for your business, keep in mind that hundreds of lawsuits have been filed nationwide for COVID negligence.  The outcomes are yet to be determined, but the possibility for liability based on failure to make efforts to mitigate the spread remains.
